Experienced Lawyers Helping Injured and Sick Workers and Their Families

Social Security Disability Insurance (SSDI) is a program intended to provide financial assistance to workers who have suffered injuries and illnesses that prevent them from working. However, many disabled workers find that filing an SSDI claim is not an easy process, and most are denied the first time they apply.

At the Law Offices of Richard Mark Baker, we help clients through this daunting process. With more than 50 years of combined experience, our attorneys know how to navigate the system to ensure our clients' entitlement to Social Security Disability Insurance benefits and Medicare.

We can do the most to help you if you call us before you file a claim, but even if you have had a claim denied, contact us. The majority of claims are denied the first time. If there are SSDI benefits available to you, we will help you find them.

Qualifying for SSDI

To qualify for SSDI:

  • You must be unable to work: SSDI is intended for people with disabilities that will keep them from working for one year or more. Depending upon your age and past work experience you may be awarded disability benefits even if you are physically able to perform other types of work. If, for example, you have always done unskilled heavy manual labor and can no longer do so, and if you are old enough and lack transferable skills, you may be awarded disability benefits and Medicare even though you are physically able to perform other lighter jobs requiring higher skill levels.
  • The disability must be long term: For an injury to qualify as a disability, it must have lasted a year, be expected to last a year or be expected to end in death.
  • You must have been working for enough time: In order to qualify for Social Security Disability Insurance benefits you must have worked and contributed to the Social Security trust fund for a total of 40 quarters (10 years).

The amount of SSDI benefits you could receive is largely dependent on how long you worked, how recently and how much you earned before becoming disabled.

If you think you might have a claim for SSDI or have been denied benefits, contact us for a free initial consultation. We will look at the facts of your case and help you determine whether you are eligible for SSDI and whether there are other workers' compensation resources available to you.
