Workers' Comp for Longshore Workers

The Longshore and Harbor Workers' Compensation Act covers workers engaged in loading or unloading oceangoing vessels, and building or repairing commercial vessels, harbors or breakwaters. It also covers workers employed by American companies operating overseas under contract to the state or defense department, especially in Europe, the Middle East (Iraq, Afghanistan), Africa, Asia and Latin America. The act also covers workers engaged in searching for or extracting resources from the Outer Continental Shelf, typically from fixed oil drilling/production platforms. Finally, the Nonappropriated Fund Instrumentalities Act provides benefits for civilian workers employed on United States military bases in the United States, typically at the Base Exchange, gas stations or restaurants.

Often workers entitled to longshore benefits are also entitled to benefits under the California Workers' Compensation Act and sometimes Social Security Disability Insurance (SSDI) benefits.

Although this legislation is intended to provide a financial safety net for workers who have been injured on the job, the reality is that these claims are complicated and filled with loopholes and ways for employers and insurance companies to deny and delay paying even legitimate claims.

At the Law Offices of Richard Mark Baker, we have more than 50 years of combined experience helping injured workers obtain all of the benefits due as a result of injuries incurred in the course of their employment. Our Long Beach longshore attorneys look to our clients' long-term needs to help them and their families for years to come.

If you are a worker who has suffered a work-related injury in any of these employment areas in California, Arizona, New Mexico, Nevada, Oregon or Washington, contact us before talking with your employer if possible.

Some of the most important aspects of longshore claims happen at the very beginning of the process. With more than 50 years of combined experience with these injuries, we can help you navigate the complicated Longshore and Harbor Workers' Compensation Act claims system to get the best results possible.

The Longshore and Harbor Workers' Compensation Act protects workers involved in longshore work, harbor construction, overseas employment and other enumerated occupations. We are well versed in the statutory language and case law involving the Longshore and Harbor Workers' Compensation Act, as well as the ancillary legislation that flows from it:

  • Defense Base Act protects workers injured while working for federal contractors outside of the United States, in Europe, the Middle East (Iraq, Afghanistan), Asia and Latin America
  • Outer Continental Shelf Lands Act applies the Longshore Act to workers aboard fixed oil drilling platforms outside California state territorial waters
  • Nonappropriated Fund Instrumentalities Act makes the provisions of the Longshore and Harbor Workers' Compensation Act applicable to civilian employees of nonappropriated fund instrumentalities of the Armed Forces, like post exchanges and military bases

We will seek any available resource to help you obtain the compensation you need for your work-related injuries and illnesses.
